1. Agreement to These Terms

These Terms of Service (the “Terms”) govern your access to and use of homeservicevideos.com (the “Site”), operated by Home Service Videos (“Home Service Videos,” “we,” “us,” or “our”), the business name of a general partnership between Welby Marketing Ltd. and Geet Chahil Productions Inc.

By accessing or using the Site, you agree to these Terms and to our Privacy Policy, which is incorporated into these Terms by reference. If you do not agree, do not use the Site. If you use the Site on behalf of a company or other organization, you represent that you have authority to bind it, and “you” includes that organization.

2. The Site Is Informational; Engagements Are Governed by Services Agreements

The Site describes our video production and video marketing packages and their current pricing for information purposes. Nothing on the Site constitutes a binding offer. Prices shown may be subject to applicable taxes and may change without notice.

A services engagement begins only when both parties sign or accept a proposal, statement of work, or services agreement (a “Services Agreement”). The Services Agreement — not the Site or these Terms — governs the scope, pricing, deliverables, and terms of any engagement. If these Terms conflict with a Services Agreement, the Services Agreement governs for that engagement.

3. Proposals

We may provide personalized proposals through unique Site links. A proposal is intended for the named recipient only, is confidential, and is valid until the expiry date stated in it (or, if none is stated, for 30 days after delivery). Pricing and scope in a current, unexpired proposal apply to its recipient in place of pricing shown elsewhere on the Site. Expired proposal links may be deactivated or redirected without notice.

4. No Guarantee of Results; No Professional Advice

Marketing outcomes depend on factors outside any provider’s control, including your market, offer, pricing, seasonality, budget, and how leads are handled once they arrive. Content on the Site is provided for general information and does not promise or guarantee any particular result, ranking, lead volume, booking rate, or revenue.

Site content is not legal, financial, tax, or other professional advice, and you should not rely on it as such.

5. Intellectual Property

The Site and its content — including text, graphics, logos, trademarks, trade names, taglines, photographs, videos, page designs, and layout — are owned by us or our licensors and are protected by Canadian and international intellectual-property laws.

We grant you a limited, revocable, non-exclusive, non-transferable licence to access and view the Site for the purpose of evaluating our services and for your internal business purposes. No other rights are granted. You may not copy, reproduce, distribute, modify, create derivative works from, publicly display, or otherwise exploit Site content without our prior written consent, except as permitted by applicable law.

“Home Service Videos,” our logo, and our taglines may not be used without our prior written permission. Client names, logos, videos, and testimonials that appear on the Site are used with permission and may not be reused or republished by you.

6. Acceptable Use

You agree that you will not:

• Use the Site for any unlawful purpose or in violation of these Terms;
• Interfere with or disrupt the Site, its servers, or its infrastructure, or attempt to gain unauthorized access to any part of the Site or its systems;
• Introduce viruses, malware, or other harmful code;
• Scrape, harvest, or mine personal information from the Site, or use automated means to access the Site in a manner that imposes an unreasonable load on it;
• Misrepresent your identity or affiliation, or submit information that is false, misleading, or that you do not have the right to provide; or
• Frame or mirror the Site or any part of it without our prior written consent.

We may suspend or block access to the Site for conduct that violates these Terms.

7. Your Submissions & Feedback

Information you submit through our forms must be accurate and yours to provide. If you send us ideas, suggestions, or feedback about the Site or our services, you grant us a perpetual, irrevocable, royalty-free licence to use them for any purpose, without obligation or compensation to you. Do not send us information you consider confidential outside of an engagement governed by a Services Agreement.

8. Communications

By submitting a form, booking a call, or calling us, you consent to our contacting you about your inquiry by phone, email, or text message. Marketing communications are governed by our Privacy Policy and Canada’s Anti-Spam Legislation, and you can unsubscribe from marketing email at any time. Calls to phone numbers displayed on the Site may be tracked, and may be recorded with notice, as described in our Privacy Policy.

9. Third-Party Content & Services

The Site embeds and links to third-party services — for example, videos hosted on YouTube and our scheduling tool. We do not control third-party services and are not responsible for their content, availability, or practices. Your use of a third-party service is subject to that party’s own terms and policies.

10. Disclaimer of Warranties

The Site and its content are provided “as is” and “as available,” without warranties, conditions, or representations of any kind, whether express, implied, or statutory — including implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, title, and non-infringement, and any warranty that the Site will be uninterrupted, timely, secure, or error-free, or that its content is accurate, complete, or current. Some jurisdictions do not allow the exclusion of certain warranties or conditions, so some of the above exclusions may not apply to you.

11. Limitation of Liability

To the maximum extent permitted by applicable law: (a) Home Service Videos and its partners, and their respective officers, directors, employees, and agents, will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, business, goodwill, or data, arising out of or relating to your use of, or inability to use, the Site, even if advised of the possibility of such damages; and (b) our total aggregate liability for all claims arising out of or relating to the Site or these Terms will not exceed one hundred dollars ($100).

These limitations do not apply to liability that cannot be excluded or limited under applicable law. Nothing in these Terms limits or excludes liability arising under a Services Agreement, which is addressed in that agreement.

12. Indemnification

You will indemnify and hold harmless Home Service Videos and its partners, and their respective officers, directors, employees, and agents, from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from your breach of these Terms or your misuse of the Site.

13. Changes to the Site & These Terms

We may change, suspend, or discontinue any part of the Site at any time without notice. We may also update these Terms from time to time; the “Last updated” date above reflects the current version. Changes apply prospectively from the date they are posted, and your continued use of the Site after posting means you accept the updated Terms.

14. Governing Law & Jurisdiction

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in it, without regard to conflict-of-laws rules. You agree to the exclusive jurisdiction of the courts of the Province of Ontario for any dispute arising out of or relating to the Site or these Terms, and you waive any objection to venue in those courts. Nothing in this section deprives you of the protection of mandatory provisions of law that apply to you.

15. General Terms

These Terms, together with the Privacy Policy, are the entire agreement between you and us regarding use of the Site. If any provision is found unenforceable, it will be limited or severed to the minimum extent necessary, and the remaining provisions will continue in effect. Our failure to enforce a provision is not a waiver of it. We may assign these Terms without notice to an affiliate or to a successor in connection with an incorporation, reorganization, amalgamation, financing, or sale or transfer of our business or assets; you may not assign these Terms without our prior written consent. There are no third-party beneficiaries to these Terms except as expressly stated. Headings are for convenience only.
